When Corporal Smith knocked on the front door of the home, he was shot and killed.<br /><br />Members of the Dallas Police SWAT team were able to make entry into the apartment and arrest three suspects at the scene, including the suspect that shot Corporal Smith.<br /><br />Corporal Smith had served with the Dallas Police Department for 18 years and was assigned to the Gang Unit. 							PT>                            					<div class="deck11"><strong>By TIM TALLEY</strong><br /><em>Associated Press Writer</em></div>			<BR />			<div id="intelliTXT">													<p>     FAIRVIEW, Okla.     -- </p><p>Opening statements began Tuesday for the trial of a former sheriff accused of using his influence over jail inmates and drug court defendants to demand sex from the women.</p><p>Former Custer County Sheriff Mike Burgess has pleaded not guilty to 36 charges of rape, rape by instrumentation, kidnapping, sexual battery and oral sodomy. He resigned in April.</p><p>Prosecutor Jim Swartz said six former jail inmates and drug court defendants will testify against Burgess, who faces up to 470 years in prison if convicted of all charges.</p><p>Swartz said that in one case Burgess asked a drug court defendant to meet him at an Oklahoma City motel. Swartz said she feared this would violate travel restrictions imposed by the court, but she agreed to it after Burgess told her: "I'm, the sheriff. I'll take care of that."</p><p>Defense attorney Steve Huddleston said during jury questioning that the backgrounds of the women making the accusations will be closely considered at trial.</p><p>Burgess, 56, was a member of a drug court panel that decided which offenders were allowed into a rehabilitation program and which were removed from the program and sent to prison.</p><p>Several female offenders testified at a preliminary hearing they feared they would be sent to prison if they did not provide sexual favors to Burgess. One woman testified she and Burgess had sex two to three times a week over a 14-month period.</p><p>Under state law, a prisoner cannot legally consent to sexual relations with a jailer or anyone else who controls the conditions of the prisoner's confinement.</p><p>The evidence against Burgess surfaced in a federal lawsuit filed on behalf of 12 former jail inmates alleging sheriff's employees had them engage in wet T-shirt contests and offered cigarettes to those who would flash their breasts.</p><p>Burgess, who is married, is free on $50,000 bail.</p><p>The trial was moved to Major County from Custer County because of intense media coverage. 							PT>                            					<div class="deck11"><strong>ROB YOUNG</strong><br /><em>Appeal-Democrat, Marysville, Calif.</em></div>			<BR />			<div id="intelliTXT">													 <p xml:lang="en-US">     Former Marysville police officer Amy Eleanor Alfred was sentenced Monday to 30 days in jail for her role in the illegal strip search of a drug suspect a year ago on a city street.</p> <p>     Yuba County Judge Julia Scrogin also ordered Alfred to serve 480 hours in a work program that could mean picking up trash along highways or pulling weeds.</p> <p>     The jail sentence is one-third as long as the one Scrogin gave former officer Joshua Hendrickson, who called Alfred to 10th and Chestnut streets last January and told her to put on latex gloves and search the suspect, Stacy Michelle May.</p> <p>     Prosecutor Shiloh Sorbello said he is satisfied with the 30-day sentence, which probably will be cut to 20 days for good behavior. The time will be served on four-day weekends, he said.</p> <p>     Scrogin stayed the sentence while Alfred appeals her conviction. Hendrickson is also appealing, and a decision from a panel of Yuba County judges is not expected for months, said District Attorney Pat McGrath.</p> <p>     While Alfred had no legal defense for what she did, she was the rookie officer at the scene while other officers, older and more experienced, did nothing to prevent the illegal search, Scrogin said.</p> <p>     Scrogin said she initially was inclined to give Alfred 90 days in jail but was influenced by a letter from former Marysville Police Chief Jack Beecham.</p> <p>     In the letter, Beecham called Alfred, who was 29 at the time of the search, a promising young officer. He criticized Police Department training.</p> <p>     "Why didn't the (superior officer, Hendrickson) know the law and if he didn't, why was she expected to know the law? There obviously was a breakdown somewhere, specifically in her training," Beecham wrote.</p> <p>     "I believe that Ms. Alfred made an honest mistake," the former chief wrote.</p> <p>     Alfred had been with the Police Department about 2 1/2 years. It was her first full-time law enforcement job.</p> <p>     Beecham, who retired three months before the incident, praised Alfred's prior record. In coaxing information from a suspect later convicted of child molestation, Alfred showed abilities beyond her age and experience, he said.</p> <p>     Scrogin said Alfred was aware that Hendrickson had previously ordered another female officer to do a similar search -- and that there had been no consequences for Hendrickson.</p> <p>     "It's very obvious to me that she didn't want to do this type of search," Scrogin said. "She was placed in a really bad situation and made the wrong call" by following Hendrickson's order, she said.</p> <p>     But Alfred was less than candid while testifying in her jury trial and did not show remorse, the judge said.</p> <p>     The Yuba County Probation Department had recommended a 90-day sentence as a deterrent to other officers.</p> <p>     Asked by a probation officer if she felt remorse, Alfred responded, "Yes, of course, if that was something that we weren't supposed to do, I feel horrible. The FBI will hire 850 agents and 2,100 professional staff positions, both at its headquarters and in various field offices, in what it's calling "one of the largest hiring blitzes in our 100-year history." </p><p> Officials told CNN it's the largest FBI job posting since immediately after the Sept. 11, 2001, terrorist attacks. </p><p> All FBI positions require a security clearance and all applicants must undergo a thorough background check. Lloyd was ordered held without bail on three counts of murder. Authorities gave no explanation for why the alleged gunman was not charged Monday.</p> <p>Cook's brother, Robert, a Cook County sheriff's deputy, said the family was relieved by Lloyd's arrest and looked forward to his trial.</p> <p>"We're happy it's got to this point," he said. "We've gotten to first base; we're just to the bond hearing. Home plate is the sentencing."</p> <p>Thomas Cook had been a Riverdale police officer for nine years but left for the Metra police force in 2003 because he thought it would be safer.</p> <p>Shortly before 10 p.m. on Sept. 27, 2006, Cook, 43, married and the father of two young children, was sitting in his marked Metra squad car conducting surveillance near the crime-ridden Metra Electric Line station at 147th Street in Harvey.</p> <p>Lloyd and his accomplice had lost weapons during a shootout with a Harvey police officer early that morning, authorities alleged. As they walked down an alley near the train station, they talked about how they needed to "do a lick &#091;robbery&#093; to get another gun," Assistant State's Atty. Joe Kosman said in court.</p> <p>Kosman said the accomplice suggested they rob a Metra cop, reasoning that a police officer would be sure to have a weapon. While Lloyd looked for other police, the accomplice walked up to the driver's side window of Cook's car, shot him twice in the head and stole his .357-caliber semiautomatic handgun, Kosman said.</p> <p>A witness met the accomplice later that night and traded a weapon for Cook's gun, officials said. The officer's gun was recovered in Robbins in August 2007 and traced back to that witness, Kosman said.</p> <p>Lloyd also told a second person to watch the news for a police officer shooting in Harvey, and when the person later confronted him about the news reports, Lloyd allegedly admitted his role in the slaying, authorities said.</p> <p>Both Lloyd and his alleged accomplice are in Cook County Jail awaiting trial on charges of attempted murder and aggravated discharge of a firearm stemming from the shootout with the Harvey police officer hours before Cook's murder.</p> <p>Jemetric Nicholson, 21, of Harvey, was charged with Lloyd in the attempted murder of the Harvey officer, court records show. He is awaiting trial on nearly a dozen violent crimes, including an unrelated murder, attempted murders, vehicular hijacking and possessing a weapon in jail.</p> <p>Robert Cook said he never stopped believing the case would be solved. "They've been as frustrated as we have because the pace hasn't been that fast," he said. 							PT>                            					<div class="deck11"><strong>By WAYNE PARRY</strong><br /><em>Associated Press Writer</em></div>			<BR />			<div id="intelliTXT">													<p>     ATLANTIC CITY, N.J.     -- </p><p>New Jersey's highest court is grappling with one of the thorniest issues facing criminal justice today: what to do in cases where witnesses to a crime have been threatened or intimidated by defendants to the point where they refuse to testify in court.</p><p>The issue is a pressing one in areas where intimidation by gang members, drug dealers and other defendants is making potential witnesses afraid they or their loved ones will be harmed or killed if they take the stand.</p><p>The state Supreme Court in Trenton heard nearly two hours of arguments Monday on a case that deals with what the state Attorney General's Office calls "the greatest threat" to prosecution in gang, organized crime and domestic violence cases.</p><p>The state wants to be allowed let jurors hear the out-of-court statements of witnesses who have been threatened without presenting the witnesses themselves.</p><p>But defense lawyers argue that would not be fair to defendants, who have the Constitutional right to confront their accusers in court.</p><p>Deputy Attorney General Daniel Bornstein told the court he has read numerous media accounts of witnesses being intimidated or threatened around the state.</p><p>"It's gotten so bad that often entire communities are cowed into silence," he said.</p><p>Some prosecutor's offices now refuse to prosecute murder cases where there is only one witness, Bornstein said.</p><p>The remedy to that is for prosecutors to be allowed to introduce evidence of conversations a witness had with police or investigators outside of court, the state claims.</p><p>The case at issue involves a 2001 murder in Trenton.</p><p>Dionte Byrd and Freddie Dean Jr. were convicted in 2004 of murdering Charles "Minnesota Fats" Simmons in Simmons' apartment, and sentenced to life in prison with no parole for 30 years.</p><p>Helping to convict them was the statement of Kenneth Bush, who told police he rode in a van to Simmons' apartment with Byrd and Dean - both of whom he said were armed - and was smoking crack in the back while they went inside.</p><p>Bush said he saw the duo run back to the van and later saw that Byrd had suffered a gunshot wound to the leg. He also said he heard both men discuss the shooting.</p><p>Bush refused to testify at trial, claiming he'd been threatened by Byrd and Dean, but the trial court permitted the state to elicit testimony about Bush's statement to police.</p><p>An appeals court overturned the convictions in 2007 on the grounds that Bush's statement was improperly admitted into evidence.</p><p>Byrd's attorney, Andrew Schneider, told the justices that in their attempt to get the rules changed, prosecutors are using "appeals to fear, anger and revenge - coincidentally the same emotions that get people into trouble."</p><p>Many of the justices worried about how to evaluate the reliability of any out-of-court statements that might be sought to be introduced at trials, even as they acknowledged that witness intimidation is a serious problem.</p><p>"There are countless cases where a witness gives a statement implicating a person in a crime, and when they get to court, they don't remember anything," said Justice Barry Albin. "There seems to be a climate of fear in certain areas where the witnesses are afraid for their lives to testify in court."</p><p>The U.S. Supreme Court allows out-of-court statements to be heard at trial under what is known as the "forfeiture-by-wrongdoing" rule - essentially, that defendants forfeit their Sixth Amendment right to confront a prosecution witness if they wrongfully cause the absence of that witness.</p><p>New Jersey's rules of evidence don't include a similar provision, though the state's brief in the Byrd case notes that "at least 31 states and the District of Columbia have adopted the forfeiture rule."</p><p>The New Jersey court gave no indication when it might issue a decision.</p><p><hr /><p><img style="float:left; margin-right:5px;" src="http://images.cygnusinteractive.com/buttons/logo_ap.gif" /><div style="font:9px;">Copyright 2008 The Associated Press. 							PT>                            					<div class="deck11"><strong>The Associated Press</strong><br /><em></em></div>			<BR />			<div id="intelliTXT">													<p>     NORMAL, Ill.     -- </p><p>Police say a man suspected of robbing four banks has been shot and killed after leading officers on a high-speed chase in central Illinois.</p><p>Authorities say the 57-year-old man robbed a Bloomington currency exchange at gunpoint on Monday and fled, reaching speeds of more than 90 mph as he bolted along interstates and rural highways.</p><p>Witnesses say the man jumped out of the vehicle onto Interstate 74 just north of Normal Community West High School. They say the man leaped over a concrete barrier and showed a gun.</p><p>That's when the suspect and officers from several jurisdictions exchanged gunfire and he was shot.
